What to Do If the Insurance Company Contacts You Directly

From the moment you sign with us, all communication with the insurer should go through your legal team. But sometimes, insurance adjusters still reach out directly. Maybe they send a friendly email. Maybe they leave a voicemail “just checking in.”

Here’s what you should know if that happens—and why it’s so important to let us handle it.

You Have No Obligation to Speak With Them

Once you’re represented by a lawyer, the insurance company is not supposed to contact you directly about your claim. If they do, you are under no obligation to speak with them, answer questions, or sign anything.

If they call you, take down their name and number. Then call us. We’ll take it from there.

They May Seem Friendly—But Their Job Is to Minimize Your Claim

Insurance adjusters are trained to be polite, reassuring, and non-threatening. They may say they “just need a quick update,” or ask questions that seem harmless—like:

  • How are you feeling these days?
  • Are you back at work?
  • Are you still going to physio?
  • Are you able to drive again?

These questions seem casual, but the answers can affect the value of your case. Anything you say could later be used to argue that you’ve recovered more than you actually have.

Do Not Sign Anything Without Talking to Us First

Sometimes insurers send forms or releases in the mail or by email. These documents often contain legal language that gives up your rights—sometimes permanently. Even a document that appears to deal with just one issue (like property damage) may have hidden language that releases the insurer from all future claims.

Please don’t sign anything, cash any cheques, or accept e-transfers from the insurance company unless we’ve reviewed the documentation first.
